NAKO Terms & Conditions

Welcome to NAKO. These Terms and Conditions govern your access to and use of the NAKO website, participation in competitions offered through NAKO, and any related services.

By using the NAKO website or entering a competition, you agree to these Terms and Conditions.

1. About NAKO

NAKO is a South African digital raffle/competition platform through which eligible participants may enter competitions for the opportunity to win advertised prizes.

2. Eligibility

Unless a particular competition states otherwise, participants must:

• be at least 18 years old;

• be legally capable of entering into a binding agreement;

• reside in South Africa; and

• provide accurate and complete information when entering.

Employees, directors, contractors, creators, influencers, agents and other persons directly involved in operating or promoting a NAKO competition may not participate in that competition. NAKO may extend this exclusion to immediate family members or other connected persons where required by law or the applicable competition rules.

NAKO may request reasonable proof of identity, age or eligibility before awarding a prize.

3. Competitions

Each competition will display relevant information about the prize and participation requirements.

Individual competitions may also have specific rules. Where specific competition rules conflict with these general Terms, the specific competition rules will apply to that competition.

Competition rules will be made available to participants without charge where required by applicable law. The Consumer Protection Act also requires promotional competition rules to be prepared before a competition begins and made available to participants on request. South African Government

4. Entries and Payments

Where permitted by applicable law and expressly stated for a particular competition, the applicable participation amount will be displayed before the participant confirms the transaction.

Current competition amounts may include R10 or R20, depending on the competition.

A participant must review the total amount displayed at checkout before confirming payment.

An entry will only be treated as confirmed after NAKO receives confirmation from its authorised payment service provider that the relevant transaction has been successfully processed.

A pending, declined, reversed, fraudulent or unsuccessful payment does not constitute a confirmed entry.

NAKO does not require customers to provide their payment card credentials directly to NAKO where payment is processed through an authorised third-party payment provider.

5. Competition Availability and Closing

Each competition will be subject to the closing criteria disclosed for that competition.

NAKO may display the progress of a competition as a percentage rather than displaying the precise number of entries received.

Where a competition is cancelled, suspended or materially changed, NAKO will deal with affected participants in accordance with applicable law and the rules applicable to that competition.

NAKO will not manipulate entry numbers, competition progress or the outcome of a competition.

6. Selecting Winners

Winners will be selected using the method disclosed in the applicable competition rules.

The selection process must be fair and conducted in accordance with applicable South African law.

NAKO may conduct reasonable verification before publicly announcing or delivering a prize, including confirming the winner's identity and eligibility.

A person who cannot satisfy the applicable eligibility requirements may be disqualified where permitted by law.

7. Winner Notification

NAKO will contact winners using the contact details provided when entering.

Participants are responsible for ensuring that their cellphone number and email address are correct.

NAKO will never require a legitimate winner to pay an additional fee to receive a prize.

If a winner cannot be contacted, fails eligibility verification or does not claim a prize within the period specified in the applicable competition rules, NAKO may deal with the prize in accordance with those rules and applicable law.

8. Prizes

Prizes are as described on the relevant competition page.

Images may occasionally be illustrative. Where applicable, the prize description will determine the prize being offered.

A prize may not be exchanged for cash unless NAKO expressly states otherwise.

NAKO will not charge a winner a fee to release or deliver a prize where doing so would contravene applicable law.

9. Delivery and Collection of Prizes

NAKO will arrange delivery or collection with verified winners where applicable.

Winners may be required to provide reasonable information necessary for delivery, including a delivery address and proof of identity.

Delivery arrangements may differ depending on the nature, size and location of the prize.

10. Refunds, Reversals and Cancellations

Transactions that have been successfully processed and resulted in a valid participation right cannot simply be cancelled because a participant changed their mind, subject always to rights available under applicable South African law.

Where NAKO cancels a competition or a payment has been processed incorrectly, NAKO will provide the appropriate remedy required by applicable law and the circumstances.

Chargebacks, payment reversals or fraudulent transactions may result in the associated entry being invalidated where legally permissible.

Nothing in these Terms limits any non-excludable consumer right.

11. Fraud and Misuse

Participants may not:

• use stolen or unauthorised payment methods;

• manipulate or interfere with the NAKO website;

• provide false information;

• interfere with winner selection;

• impersonate another person;

• exploit technical errors to obtain entries or prizes; or

• engage in conduct intended to undermine the fairness or integrity of a competition.

NAKO may investigate suspicious activity and take reasonable action, including withholding a prize while eligibility or suspected fraud is investigated.

12. Creator and Referral Codes

NAKO may issue creators or marketing partners with unique referral links or codes.

These codes may be used to measure campaign attribution and do not provide a discount unless expressly stated otherwise.

Creators, influencers or other persons promoting a NAKO competition are not permitted to represent themselves as winners or make false or misleading claims about NAKO.

13. Website Availability

We aim to keep NAKO available and accurate but cannot guarantee uninterrupted access.

Maintenance, payment-provider outages, internet failures or circumstances outside our reasonable control may temporarily affect the service.

Where a technical error materially affects a competition, NAKO will take reasonable steps to correct the issue and protect participants' rights.

14. Intellectual Property

The NAKO name, branding, website design, original content, graphics and other intellectual property belonging to NAKO may not be copied, reproduced or commercially exploited without permission.

Third-party trademarks and product names remain the property of their respective owners.

Unless expressly stated, the presence of a third-party product as a prize does not imply sponsorship or endorsement by that manufacturer or retailer.

15. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under South African law.

To the extent permitted by law, NAKO will not be liable for indirect or consequential losses arising from circumstances beyond its reasonable control.

16. Privacy

Personal information is processed in accordance with the NAKO Privacy Policy and applicable South African data-protection legislation, including POPIA.

17. Changes to These Terms

NAKO may update these Terms where reasonably necessary, including to reflect legal, regulatory, technical or operational changes.

The latest version and effective date will be displayed on the website.

Changes will not retrospectively deprive participants of rights already vested under applicable law.

18. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and any consumer dispute-resolution rights available to the participant.
